Babayemi Vs Adeleke, Federal High Court Fixes Date For Judgement
A Federal High Court sitting in Osogbo on Monday fixed Wednesday,18th May, 2022, for the delivery of judgement on the case instituted by Omooba Dotun Babayemi against the Peoples Democratic Party, PDP, Independent National Electoral Commission, INEC and Senator Ademola Adeleke.
In the suit, Babayemi a factional gubernatorial candidate of PDP is challenging the nomination and submission of Senator Ademola Adeleke by the Peoples Democratic Party to INEC as the flag bearer of the party and the validity of the governorship primaries conducted at the Osun State stadium, Osogbo against the authentic delegates who voted at the party primaries at WOCDIF as ordered by the court.
The presiding judge, Justice N Ayo-Emmanuel after listening to arguments by all Counsels to the respective parties, adjourned to Wednesday,18th May, 2022, for the delivery of judgement in the suit No: FHC/OS/CS/26/2022 instituted by Babayemi.
While Mallam Yusuf Ali (SAN) led other Counsels for the plaintiff, Atolagbe, appeared for PDP, and Jimi- Bada for Senator Ademola Adeleke.
Earlier, Justice Ayo-Emmanuel had dismissed the application of some litigants to be joined in the suit instituted by Dotun Babayemi.
It will be recalled that on 3rd March, 2022, an Osun State High Court sitting in Ijebu-Jesa, had authenticated the Ward Congress that produced 215 delegates which eventually produced Dotun Babayemi under the then state Chairman.
Also on 10th March, 2022, the same court pronounced that the PDP governorship primary election that produced Babayemi as the gubernatorial candidate of the party in Osun was the legally recognized because the delegates that voted for him were the ones backed by the law.
